Terms and Conditions

As Described in the Travel Services Agreement

Before Key to Fun Vacations LLC d/b/a Key to Fun Vacations (“Travel Agency” and/or “Agency” and/or "we/us/our") finalizes arrangements for your trip and you (the “Client” and/or "traveler" and/or "you/your") submit payment to secure your deposit, Travel Agency requires that you sign and submit this Travel Services Agreement (“Agreement”) form. This Agreement is made between Key to Fun Vacations LLC, whose registered office is at 8958 W State Road 84, Davie, FL 33324, and the Client. Your electronic signature will signify your agreement with the following terms and conditions, effective date signed and submitted. By using our services, you hereby agree to the terms and conditions on behalf of yourself and all members of your traveling party. 


1. Agent for Suppliers: Key to Fun Vacations LLC, an affiliate of Travel Quest Network, acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in Client’s itinerary or confirmation (“Suppliers”). Travel Agency, therefore, shall not be responsible for breach of contract, failure to comply with any laws such as the Americans with Disabilities Act (ADA), or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience, or injury to Client’s or members of Client’s travel party. Travel Agency is not responsible for the acts or omissions of the Suppliers or their failure to adhere to their own schedules, provide services or refunds, financial default, or failure to honor future trip credits. Travel Agency has no special knowledge regarding the financial condition of the Suppliers and no liability for recommending a trip credit in lieu of a refund. It is the Client's responsibility to review the Suppliers' terms and conditions prior to approving any quotes or proposals and before a booking is made. 


2. Accuracy Disclaimer: Quoted prices and availability are subject to change and cannot be guaranteed. No quotes for service are considered final until Travel Agency receives written confirmation from the Supplier(s) and direct payment from Client is accepted on said quote, and payment has been charged to a major credit card made out directly to the Supplier(s). Client must reconfirm all their travel plans on official web sites, with their Key to Fun Vacations travel agent, and/or Suppliers’ official publications before the start date of their trip. Travel Agency may supply Client the official website and/or contact information of a Supplier upon request and if the requested information is available to the general public.


3. Release of Liability and Covenant Not to Sue: Travel Agency assumes no responsibility for and shall not be liable for the acts or omissions of any party not under its control, or any acts of God, unsafe conditions, terrorism, social or labor unrest, mechanical or construction failures or difficulties, health hazards including pandemics, illnesses, weather hazards, or the suitability for a disabled person of any portion of any trip. Travel Agency has no special knowledge of dangers during travel or at destinations. 

Client understands and voluntarily assumes the risks, both known and unknown, associated with the trip or activities.

For information concerning possible dangers at international destinations, Client should review the U.S. Department of State travel website at www.travel.state.gov. For medical and health information, Client should visit the Centers for Disease Control website at www.cdc.gov/travel. Client’s personal decision to travel is with full knowledge of current travel recommendations and travel restrictions with regards to the risks of physical harm, including COVID-19 and other communicable diseases. CLIENT HEREBY EXPRESSLY ASSUMES ALL OF THESE RISKS AND DANGERS, AND CLIENT HEREBY EXPRESSLY AGREES TO FOREVER RELEASE, DISCHARGE AND HOLD TRAVEL AGENCY, AND ITS AGENTS, EMPLOYEES, OFFICERS, DIRECTORS, ASSOCIATES, AFFILIATED COMPANIES, GUIDES, GROUP LEADERS, AND SUBCONTRACTORS HARMLESS AGAINST ANY AND ALL LIABILITY, ACTIONS, CAUSES OF ACTIONS, SUITS, CLAIMS, AND DEMANDS OF ANY AND EVERY KIND AND NATURE WHATSOEVER WHICH CLIENT NOW HAS OR WHICH MAY HEREAFTER ARISE OUT OF OR IN CONNECTION WITH THESE RISKS AND DANGERS.


Client agrees to RELEASE, DISCHARGE, COVENANT NOT TO SUE AND HOLD HARMLESS Key to Fun Vacations LLC and its owner.

4. Insurance: By embarking upon travel, the Client voluntarily assumes all risks involved in such travel, whether expected or unexpected. Client is hereby warned of the above risks as well as possible travel industry bankruptcies and medical and climatic disruptions, and the possibility Client may be unable to travel as scheduled because of a personal emergency. Client is advised to obtain appropriate insurance coverage against these risks. Information is available through the Travel Agency regarding travel insurance. 


Travel Agency is not an insurance provider. Client is responsible for reading the terms of proposed travel insurance and understanding the coverage and limitations of the policy. No representation or description of the insurance made by the Travel Agency constitutes a binding assurance or promise about the insurance. Client agrees to hold Travel Agency harmless for their election not to purchase travel insurance or for any denial of claim by travel insurer as it relates to COVID-19 or any other claim under the policy.


Clients who decline travel insurance assume all associated risk in doing so and may be required to sign an Insurance Waiver Form to finalize their booking.

5. Vaccination Requirements and Other Foreign Entry Rules: Travel Agency has no responsibility for COVID-19-related requirements that Suppliers and governments may impose from time to time, such as required vaccinations, health affidavit forms, COVID-19 screenings prior to departure or upon arrival, face coverings, or quarantines. For the latest COVID-19 government travel regulations, Client may visit IATA’s website at https://www.iatatravelcentre.com/world.php. For the latest travel supplier rules, check the website of each Supplier regularly, as rules are constantly changing, and Travel Agency is not responsible for those changes. 


Client assumes full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination and their connecting points; and all conditions regarding health, safety, security, political stability, and labor or civil unrest at such destination. Many countries require travelers’ passports to be valid for six months or more after their date of entry. Some countries will not admit persons convicted of a crime. Some countries require both parents’ consent for minors to travel. Travel Agency advises United States (“U.S.”) Citizens traveling abroad do so with a valid U.S. Passport whose expiration date is at least six months after travelers’ date of entry.

6. Fees and Pricing: Key to Fun Vacations LLC is an Independent Agent of Travel Quest Network and operates under the host agency’s Seller of Travel licenses as required by law. Key to Fun Vacations LLC is registered as an independent sales agent with the State of Florida as a Seller of Travel Registration NO. ST36257. Travel Agency does not charge a separate booking or service fee and only provides invoices that reflect the pricing of Suppliers. If a Supplier reduces the price of a trip after booking, the Travel Agency will try to assist the Client with rebooking if the Supplier allows it, and a fee may apply. Travel Agency does not guarantee any refunds or successful rebooking.


Travel arrangements involving airline and cruise components are subject to Suppliers’ supplemental price increases that may be imposed by the supplier and/or government, even after Client has completed their purchase. Client hereby consents to any such price increases and authorizes their credit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and Client may be bound by those contracts regardless of whether Client receives notice of their terms.

7. Payment: New Clients must book at least 30 days in advance of their start travel date. A credit card is required to place a deposit for a booking so that the Client may exercise their rights under the Fair Credit Billing Act if they do not receive the services they purchased. Client must submit a Credit Card Authorization Form for payment and submit to the Travel Agency at least 30 days in advance to secure a deposit. After receiving the necessary documentation needed to place a deposit on a booking, the Travel Agency will submit the authorized payment directly to the Supplier(s) on the Client's behalf within 15 days of receipt. The credit card holder used for the purpose of booking the trip must be a member of the travel party. Client agrees to pay the booking in full by the final payment date as noted in the Suppliers’ invoices, or risk cancellation of their booking. The Travel Agency will notify the Client of a payment deadline, but it is the Client's responsibility to provide payment information by said deadline. Client may elect to make additional/early payments towards a balance when applicable, according to the terms set by the Supplier(s). Client must submit a new Credit Card Authorization form to authorize a payment schedule or for each additional payment, including final payment. If the Suppliers do not provide the services agreed upon, Client’s only recourse would be against the Suppliers, and Client agrees not to initiate a chargeback against the Travel Agency.

8. Cancellation Policy: A Client may request a change or cancellation to bookings. The request must be submitted in writing to the Travel Agency and include the confirmation number(s) associated with the booking(s). Client is responsible for any fees associated with cancellations or changes to bookings. Travel Agency does not assume any responsibility for fees or other penalties associated with any changes to bookings.


9. Client Responsibilities: The Client agrees to assume responsibility for the following:

  • Responsiveness with the Travel Agency through communication channels like phone calls, texts, emails, and chats
  • Providing accurate and complete information as requested by the travel advisor
  • Acquiring any essential documentation, supplies, or materials required for travel
  • Submitting payment details within the specified deadlines
  • Reviewing all travel documents and notices prior to departure
  • Checking in to flights, hotels, and cruise lines as required by the supplier and/or provider

This list is non-exhaustive and may vary based on the type of travel and Suppliers used for the booking.


10. Entire Agreement: This Agreement (including the documents referred to herein) constitutes the entire agreement among the Travel Agency and Client with respect to the subject matter of this Agreement and supersedes any prior agreements or understandings, oral or written, between the parties with respect to the subject matter of this Agreement. It is the sole responsibility of the Client to share the terms and conditions of this Agreement with their travel party.

11. Electronic Signature: Travel Agency and Client agree that this Agreement may be electronically signed. The parties agree that the electronic signatures appearing on this Agreement are the same as handwritten signatures for the purposes of validity, enforceability, and admissibility. By signing Client’s name below and submitting this form, Client agrees to the terms provided on this page, and understand this is a legally binding agreement.

 
12. Governing Law: This Agreement is governed by and is to be construed in accordance with the laws of the state of Florida. If any part hereof is held to be invalid or legally unenforceable for any reason, the remainder of the terms of this Agreement shall not be affected thereby and shall remain valid and fully enforceable.

13. Privacy Policy: Key to Fun Vacations LLC ("Key to Fun Vacations," "Travel Agency," "Agency") collects information when you ("Client," "travel party") submit an online from via our website or a partner's website, when you subscribe to the Agency's newsletter, or when you send an email to the Agency.


Key to Fun Vacations LLC collects Client’s (and that of Client’s travel party) personal information in order to provide Client and the Client’s travel party with the products and services requested by the Client.


Personal information may include, but is not limited to, the traveling party’s full legal names, home addresses, email addresses, phone numbers, credit card information, passport numbers, known traveler numbers, and other travel-related information.


Key to Fun Vacations enters your information on Suppliers' websites as required to make a booking. The Agency also stores your information in a Customer Relationship Management (CRM) system to provide services for which the information is needed. Credit card numbers are not permanently stored and are only collected via PCI-compliant methods to authorize payments.


Key to Fun Vacations uses a third-party service (Travefy) to collect and store information via online forms. Please refer to Travefy's Privacy Policy for additional information.


Travel Agency shares Client’s personal information as necessary with Travel Agency’s host agency, airlines, cruise lines, hotels, car rental companies, and other Suppliers or providers for whose services Client has requested. Travel Agency may share Client’s contact information with the Agency’s partners to assist with marketing the Agency’s products and services. 


Client may unsubscribe from receiving future commercial email communications from Travel Agency by clicking the “unsubscribe” link included at the bottom of any marketing emails. However, Travel Agency reserves the right to send Client transactional emails such as customer service communications in connection with the products or services Client has purchased. 


Travel Agency does not sell or lease personal information to third parties. However, if another entity acquires Travel Agency or all (or substantially all) of the Agency’s assets, the information the Travel Agency has about the Client will be transferred to and used by this acquiring entity. If any bankruptcy or reorganization proceeding is brought by or against the Travel Agency, all such information may be considered an asset of the Agency and as such may be sold or transferred to third parties. Travel Agency may also share Client’s information to protect and defend the Agency’s rights and property.
